Terms of agreement

>TERMS OF AGREEMENT – YACHT PURCHASE

The BROKER is obliged to try to find a vendor and introduce him to the buyer, with whom he will negotiate the sale. This agreement includes all vessels that BROKER found for the buyer, and the buyer is obligated to pay the BROKER an agreed commission fee if a sale is concluded.

The buyer is obligated to pay to BROKER's account the commission fee of 4% (four percent) of the agreed purchase price, increased for VAT (22%), maximum 14 days after signing the sale contract, unless agreed differently.

The buyer is obligated to pay for the costs of survey and test drives. The vendor is obligated to pay for the survey in case a defect was found, which the seller purposely tried to hide.

The buyer is obligated to pay for the costs of legal acts (determining the legal status of the vessel), vessel value assessment costs (if requested by the CLIENT) and all examinations of the vessel, as well as all other costs made on buyer’s request.

If the buyer abuses the BROKER's information by giving the information to other broker agencies, concluding the contract without the BROKER with the vendor with whom he was introduced to by the BROKER, or misuses the information in any other way that might be harmful for the BROKER, the buyer is obligated to pay the BROKER the entire commission fee of 4% (four percent) of the purchase price, increased for VAT.

The agreement is valid provided the vessel is not under mortgage or any other judicial inquiry.

All matters of dispute will be handled at the Competent Court in Split, Croatia.

TERMS OF AGREEMENT – YACHT SALE

The BROKER is obliged to try to find and introduce to the vendor a buyer with whom he will negotiate the sale, and the vendor is obligated to pay the BROKER an agreed commission fee if a sale is concluded.

The vendor is obligated to pay to BROKER's account the commission fee of 4% (four percent) of the agreed purchase price, increased for VAT (22%), maximum 14 days after signing the sale contract, unless agreed differently.

The vendor avouches that he is the sole owner of the vessel and that there are no accounted or unaccounted claims or encumbrances on the vessel, as well as that he possesses all documentation of the vessel.

If the vendor would conclude the sale contract or agreement without the BROKER with the buyer with whom he was introduced by the BROKER, the vendor is obligated to pay the BROKER commission fee in the amount of 4% of the vessel price, increased for VAT, maximum 14 (fourteen) days upon signing the sale contract.

The vendor agrees to pay the BROKER commission fee in the amount of 4% of the vessel price, increased for VAT, if he, without valid reason, withdraws from sale after the BROKER had found a buyer interested in concluding the sale. The vendor will pay the commission fee maximum 14 (fourteen) days upon withdrawal notice.

The buyer is obligated to pay for the costs of survey and test drives. The vendor is obligated to pay for the survey in case a defect was found, which the vendor purposely tried to hide.

The vendor is obligated to pay for all costs made on his request.

The vendor is not obligated to pay the BROKER commission fee if he finds a buyer himself, provided he didn’t learn about the buyer from the BROKER.

If the buyer sold the vessel himself, he is obligated to notify the BROKER within 7 (seven) days.

All matters of dispute will be handled at the Competent Court in Split, Croatia.
